I cannot recall who the author of the quote was; it may have been the late Indian Prime Minister Indira Gandhi.That quote was foremost in my mind during the past six weeks as I read and watched reporters, television anchors, commentators and so called legal analysts find Casey Anthony guilty before twelve jurors of her peers even got to deliberate on the case.By now everybody in the U.S. and in the greater Western World know who Casey Anthony is. For the uninformed she is the young white mother from Orlando, Florida, who was accused of murdering her three-year-old daughter and disposing her body like garbage. Her trial ended this week.Not since the O. J. Simpson murder trial has the American public been so captivated with a murder accused. This trial was more famous and widespread than the O.J. trial, because whereas the Simpson trial was basically a print and television event, the Casey Anthony trial had another powerful outlet, the internet, blogs social media such as Facebook and Twitter.Casey was charged some three years ago for the murder of her daughter, the child’s body was found some six months after she went missing. The case then generated large scale publicity as is has during the six week trial which as I said ended this week.People were camping outside the Orange County court house at nights, some lining up at 3am with the hope of obtaining one of the limited numbers of seats available for spectators during that day’s trial.Tourists were coming from different parts of the country not only to get an opportunity to attend the trial, but they were taking flowers and teddy bears to the site where the body was found. It was like a shrine; there was also a steady stream or people passing by her parents’ house, I guess to see where she lived. It was unreal.Across the Orange Court House was a city of tents housing media personnel. These tents had all the comforts of a home; every major T.V network and Cable Channel had teams working there.I should point out that in Guyana the media is very limited on what it can report or comment on cases, not so in the U.S. media here can comment on cases and make criticism whether it be the judge, the accused or even the attorneys involved.There was so much publicity about the case that jurors had to be selected from outside the jurisdiction and brought to Orlando. These eighteen jurors, twelve plus six alternates, were taken from their homes and families and sequestered in hotels for six weeks.The case pitted a high powered legal team from the State’s (Florida) Attorneys office led by a State Prosecutor for 30 years, Jeff Ashton, against an unknown attorney of three years’ experience, who basically tried DUI cases.Ashton was known as one of the first Prosecutors to introduced DNA evidence. The defense was led by Jose Baez who was selected randomly by the accused. In fact Baez was not qualified under Florida Bar rules to try a Capital case (murder). He never tried a murder case, and he had to enlist a co counsel who was qualified to try capital cases, while he maintained lead counsel status.From the beginning of the trial it lined up to be a David vs. Goliath trial, the very experienced prosecutor versus the inexperience unknown lawyer. Many wondered why the accused did not take an experienced lawyer.Because of the widespread publicity the case generated there was a number of attorneys who were willing to work pro bono. For whatever reason, she stood with Baez. This is where the American media comes in.Almost every commentator, legal analyst and T.V anchor ridiculed the defense attorney,Cheap NFL Jerseys, clearly stating he was “over his head”, and from their comments they had already found Casey guilty and were only waiting for the jury to confirm their opinions.Some of these analysts were experienced trial lawyers, former prosecutors, judges as well as law school professors. They all came to the same conclusion, the accused will be found guilty; the forensic evidence, DNA, etc were overwhelming.The state even tried to introduce a new science “the smell of death” air they extracted from the trunk of the accused car where they felt the victim’s body was stored decomposed.In the U.S there is a “farm” where human bodies are left to rot. Various tests are made in the varying stages of decomposition, which helps in murder investigations. The state wanted the jurors to get a wisp of the smell, but the judge wisely disallowed it.The defense called it “phantom science”; the funny thing with experts, there is always an expert who will disagree with another expert witness, creating doubts in the jurors’ mind.The prosecution cases relied on the theory that the accused suffocated her child with duct tape and disposed of her body. Why? Because she liked to party and the child was in her way.I am not so sure a mother would want to kill her three-year-old daughter just to go out to party, but that was their case. There was one problem. The medical examiner said she could not determine the cause of death, in other words no one could say if she was murdered or died accidentally.The medically examiner (who has a popular T V reality show on Post Mortems) decided that it was still a homicide, based on speculative reasons such as nobody reported the child missing.Well I am no lawyer, but as a reporter I have covered quite a few murder cases. I have seen some of the best criminal lawyers such as the late Sir Lionel Luckhoo and the late J.O.F Haynes at work. As I watched these so call “legal scholars” predicting a guilty verdict, I am wondering which law school they attended; I predicted at the opening of the trial that the jury will find her not guilty.If you don’t know how the person died how can you convict the person of murder? The defense claimed that the child drowned accidentally. Duct tape was found on the child’s skeleton (the body was decomposed) which the prosecutor claimed was used to suffocate her.The State threw all its “big guns” at the defence, but the poor defense lawyer stuck to the law, stuck to the elements that constitute a capital offence and created enough doubt.So when the verdict came out this week the jury found her not guilty on all three charges relating to the capital offence, but finding her guilty on four minor charges of lying to the police.Complete shock to these “experts”. After the verdicts they spent the last few days backpedalling on their views, some even apologizing, while for others the jury system was at fault. Apparently the system only works when it confirms to their views. Their complete ignorance of the basic elements of the law was exposed to the millions of viewers.One particular TV personality, Nancy Grace, called the jurors “cookie jurors” because they did not bring a guilty verdict.It is funny how people view justice. Many proclaimed justice was not done. When you have a six-week trial and twelve jurors who deliberated for over ten hours before arriving at their verdict, how could you say the system did not work?Only one person know how that sweet child met her death and that is her mother Casey Anthony.
