Appearing once again before (Ag) Chief Magistrate Priya Sewnarine-Beharry yesterday at the Georgetown Magisterial Court were the seven individuals who were arrested and charged following the brazen robbery at businessman Malcolm Panday’s residence at Bel Air on July 12,New York Mets Mike Piazza Jersey, last.Panday’s mother-in-law, Chandrada Rampersaud; Hardat Kumar, 23, of Owen Street, Kitty; ex-policeman Shawn Hinds, 40, of 552 East Ruimveldt Housing; Jermaine Mitchell, 20,St. Louis Cardinals Jedd Gyorko Jersey, of YY 15 North East La Penitence,Los Angeles Dodgers Chase Utley Jersey, a porter at the Continental Company; Rabindra Seemangal, 20,Los Angeles Dodgers Enrique Hernandez Jersey, 100 Sheriff Street; Aubrey Simon, 21, 14-14 Princes Street; and Rayon Jones of Lot 2 Hardina Street, Wortmanville, were all present at the court with hopes that the Prosecution had obtained the legal advice from the Director of Public Prosecutions (DPP) as it related to their case(s).At the last court appearance there was an adjournment of the hearing since the prosecution was awaiting advice from the DPP on how to proceed, thus the case was scheduled to resume yesterday.According to Police Prosecutor Steve Harvey,New York Mets Zack Wheeler Jersey, he was not in receipt of the file which was sent to the DPP therefore he requested that Magistrate Sewnarine-Beharry adjourn the matter until a ‘short date’ later until the prosecution could obtain the much needed advice.The Prosecution was unable to get advice from the DPP as to how to proceed in the matter since the charge is indictable and the advice was needed to ascertain if the case(s) should be continued as indictable charges or if the Magistrate would have to decide the matter (statements having to be taken).Magistrate Sewnarine-Beharry expressed her dissatisfaction in the fact that the prosecution could not have done so already since that was the purpose of the last hearing being adjourned.“I must say that I am disappointed.”Attorney-at-law Randolph Kirton whose client Rayon Jones was previously placed on $300,Los Angeles Dodgers Howie Kendrick Jersey,000 bail for the charges he faced told the court that if the case was going to face another adjournment it would not be fair to the other defendants who have been incarcerated since July 14 and have not been granted bail.Representing Aubrey Simon,Baltimore Orioles Brooks Robinson Jersey, was attorney-at-lay Raj Hookumchand who made an application for bail for the young man stating that the “every day a delay in granting bail isn’t negative to the prosecution but to the defendants since they have to remain in prison”.He told the court that his client should be given an opportunity to continue pursuing his studies since he was a final-year student at the University of Guyana and this would have an effect on his future.“When a court says something it must mean it and the court must frown upon the practice of having its orders disobeyed,” said Hookumchand as he addressed the matter of having another adjournment in the matter.He pleaded with Magistrate Sewnarine-Beharry to allow his client to pursue his studies while answering to the charge(s) even if it meant that he would have to report to a police station and surrender his passport to police authorities.Hookumchand asked that bail for Simon be granted in a reasonable sum.Kumar’s lawyer, Omeyana Hamilton also made an application for bail for her client while explaining that he was not a flight risk.Attorney-at-law Vic Puran who represented Shawn Hinds (already on bail) and Chandrada Rampersaud was not pleased with the prosecution’s application for another adjournment.“I am not asking for bail I am asking for the cases(s) against my two clients to be discharged. The court has bent backwards to accommodate the prosecution in this matter.”Prosecutor Steve Harvey objected to bail for the defendants citing the “gravity of seriousness” as reason for his objections.With these issues surrounding the case,San Francisco Giants Mel Ott Jersey, Magistrate Sewnarine-Beharry adjourned the matter to September 27, but not before asserting “I will definitely have to reconsider my position if there are any further delays as it regards to the issue of advice”.It is alleged that on July 12, at Bel Air the accused robbed Anne Ramsood of $7.4M, property of Malcolm Panday.Another charge stated that Jermaine Mitchell, Rabindra Seemangal, Aubrey Simon and Rayon Jones robbed Ramsood of one Blackberry curve cell phone valued at $47,000 and $380,000 cash.A separate charge against Aubrey Simon stated that on the day in question, he had in his possession eight rounds of 9mm ammunition.Another charge against him stated that on the same day he had in his possession one unlicensed 9mm pistol. It was further alleged that Simon fraudulently used identification mark PKK 3700, on a motorcar.Police Prosecutor Steve Harvey had previously told the court at an earlier date that police investigations revealed that the mother-in-law was once employed at the home as a house keeper, but was fired and subsequently told a cousin about the monies the Pandays kept in the house.The court was told that subsquently all the defendants started planning the robbery.According to the prosecutor,Cleveland Indians Juan Uribe Jersey, Simon is the registered owner of one of the vehicles that the police towed away from the hotel compound at which several of the accused were apprehended.The court was told that the suspects went to the home armed with guns and proceeded to rob Anne Ramsood.According to Harvey, Panday managed to slip away from the house to call the police. He further told the court that the “getaway” car was spotted and the police gave chase after it. The defendants were eventually cornered in the Ocean Spray Hotel compound and arrested.Harvey said that the persons broke into the home of the Pandays and used a gun to rob the family. He told the court that they were positively identified by Ramsood as the persons who committed the act. |
