A 21-year-old D’Andrade Street, Newtown man will be spending the next 10 days in prison after he was charged with two counts of carnal knowledge. The accused Jason Clarke, a Real Estate Agent, made his appearance at the Georgetown Magistrates’ Court before Magistrate Hazel Octave-Hamilton to answer a charge of having carnal knowledge of a 14-year-old girl on Wednesday July 9 at D’Andrade Street. It is also alleged that even earlier,Cheap NFL Jerseys, on March 22, he had carnal knowledge of the same female. Both charges were indictable and the accused was not required to plead.Clarke was represented by defense counsel, Roger Yearwood,Wholesale Jerseys China, who,Wholesale Jerseys, in his bail application,Wholesale NFL Jerseys, told the court that on July 9,Wholesale China Jerseys, when one of the incidents allegedly occurred,Wholesale Jerseys Free Shipping, his client was hospitalized. He said that his client was arrested after the parent of the teen was not finding her and they checked with him,Wholesale Stitched Jerseys, since everyone were aware that the accused and the virtual complainant were ‘boyfriend and girlfriend’.Yearwood added that on the night of July 9 his client was at the Georgetown Public Hospital being treated for asthma. At that point a document was tendered to the court but it turned out that the accused was at the hospital on July 11.The lawyer then shifted his plea and reported that Clarke has never been in trouble with the law and given the fact that the offence is bailable, then bail should be granted. He also pointed to his client’s medical condition.Police Prosecutor Desiree Fowler countered that if released on bail it is likely that the accused would interfere with the virtual complainant. The issue of the prevalence and seriousness of the offence was also raised. At that point, Yearwood argued that almost every offence before the court is prevalent and that argument should not be a ground for bail to be refused.Throughout his appearance, Clarke remained seated. On occasions he had to be supported by another prisoner as he kept wheezing, a sign of asthma attack. But despite his evident medical condition the magistrate refused bail on both charges. Clarke was remanded and is expected to make his next court appearance on July 24. |
