A father of four was yesterday sent to spend the next 12 months in the Camp Street penitentiary by (ag) Chief Magistrate Priya Beharry after he pleaded guilty to obtaining money by false pretence.The man, Patrick Benton, of 266 Industry,NFL Jerseys Supply, East Coast Demerara, was employed as a driver at the Ministry of Public Works.It is alleged that between November 2, and November 26, last, Benton obtained from Nicholas Raficky, $108,000 falsely pretending that he was in the position to obtain a firearm license for him. Police prosecutor Stephen Telford told the court that Benton and Raficky are known to each other. And on the day in question Raficky told Benton that he wanted a firearm license.The prosecutor said that Benton convinced Raficky that he was in the position to attain the licence and was paid the money. After some time had elapsed and the defendant failed to come up with the document, Raficky reported the matter to the police and the defendant was arrested. Relating his version of the incident, Benton told the Magistrate that he did receive the money but insisted that he told Raficky that he could help him obtain the license through a senior individual in higher office.He added that for reasons unknown to him the senior individual did not keep his part of the agreement. The defendant acknowledged in open court that he was willing to reimburse Raficky.But Telford told Magistrate Beharry that the court should not accept the defendant’s sympathy statement.The prosecutor added that the defendant set out to tarnish the names of senior officials who have no knowledge of the incident. The defendant should face the brunt of the law, he said.
