…as relocation controversy continuesEven as the Mayor and City Council (M&CC) moves to reorganize and clean up the municipalities and streets of Georgetown, it continues to be met with various hurdles.The disputed structures in front of the former Guyana Stores Bond.In the aftermath of attempts to clear Water Street on Monday which continued into Tuesday and Wednesday, the M&CC has run into a legal stumbling block. On Monday it was reported that Town Clerk Royston King had moved to clear Water and Longden Streets of illicit structures and rid the pavements of illicit vending as part of an ongoing effort to restore order and beautify Georgetown.Several persons that were owners of structures on Water Street immediately at the front of the former Guyana Stores bond had asked for an extension of time to remove their stocks and dismantle the structures. This extension was since granted.This newspaper learnt from City Hall’s Public Relations Officer (PRO) Debra Lewis that the said vendors were given multiple notices to remove. She further stated that on Tuesday they were given twenty-four-hours to vacate the premises. Subsequently M&CC workers dismantled the illicit structures during the course of Wednesday.The displaced vendors were promised to be relocated to the empty lot behind Parliament building on Hadfield Street. The move has been delayed because of preparation works being done at the new site designated for vending.The PRO in an interview with Kaieteur News had stated that the M&CC wanted the vendors to “be in a comfortable and secure environment”, the new location is slated to be equipped with proper lighting and sanitary facilities.Following Wednesday’s dismantling of the structures along the Water Street pavements, one vendor Peter Warner, moved to obtain an ex parte injunction barring City Hall from removing him from in front of the former Guyana Stores bond which is now owned by Mr. Malcom Panday.In his application to the High Court, Warner listed several points that were of interest. Notably he stated that he has been a clothing vendor for fifteen years and has been peddling his wares in front of the old Guyana Stores bond for the same amount of years. He further indicated that five years ago, the owner of the building,Wholesale Cheap Jerseys, Malcom Panday had met with several vendors, inclusive of himself. During the meeting it is stated that Panday granted them permission to vend and erect stalls on his property until he needed said property.Warner continued that his stall is the only place that he has to store his inventory and further stated that it does not hinder or interfere with the traffic on the pavement.In his application it was noted that he attended a meeting at City Hall on the 28th of April at the request of M&CC. He continued that he and several other vendors were told to come out and participate in a cleanup effort for Georgetown on May 1st.The vendor further stated that he participated in cleaning around the former Guyana Stores Bond inclusive of all drains, parapets,Jerseys From China, pavements and vending areas in and around Water Street.Continuing in Warner’s application,Wholesale NFL China Jerseys, it was noted that on May 3rd, M&CC issued a notice addressed to “all Vendors with structures on the Guyana Stores Bond” instructing them to “remove your structures within 24 hours”, “if you have a stall in any of our Markets please return to it immediately” and “please cooperate with the Council to clean up the City of Georgetown”.The clothing vendor noted that more importantly,Cheap NFL Jerseys China, the notice recognized that the property on which he was vending is the Guyana Stores Bond premises and he stated that “it is not the property of the Mayor and City Councilors of the City of Georgetown.”Warner continuing in his application said that in an effort to cooperate in the cleanup campaign he attempted to gain additional information from officers of the city council regarding the reason for the removal of the vending structures and stalls, the length of time that was required for the cleanup campaign and the date when the vendors would be allowed to reoccupy and restart their business operations. He noted that all attempts had yielded no satisfactory answers.In the application it is stated; “It therefore appears that the Respondent/Defendant (M&CC) is directing us to remove from the said private property for an indefinite period of time with no certainty as to our reoccupation of the area. “Warner stated he was advised by his lawyer, Mr. Rajendra Jaigobin,Wholesale China Jerseys, that the M&CC have no power according to the Municipal and District Councils Act,Cheap NFL Jerseys, Chapter 28:01,Wholesale Authentic Jerseys, to “order the removal of my stall and the goods and merchandise therein from the portion of land known as the former Guyana Stores Bond.”“The Vendors occupying the portion of land known as the former Guyana Stores Bond have a valid and existing license from the owner, Mr. Malcolm Panday of the said property, and this license cannot be revoked or interfere with by either the Respondent/Defendant or any other officer of the Mayor and City Council of the City of Georgetown”“The directions issued by the Respondent/Defendant, including myself, made and contained in notice made and contain in notice dated the 3rd of May, 2016 are unlawful and illegal.”The applicant is suing the M&CC for damages amounting to three hundred thousand Guyana dollars for damages to property, trespassing and detinue.Warner’s ex parte application for an injunction against M&CC was granted by the Honourable Madam Justice Roxanne George on Wednesday. The injunction stated that M&CC is restrained from removing any goods belonging to Warner or destroying his property.Kaieteur News spoke to Deputy Mayor Sherod Duncan via telephone yesterday, Duncan stated that he was unaware of this development. PRO Debra Lewis when reached for comments on this issue also said that she was unaware of any such thing. This newspaper attempted to contact Mayor Patricia Chase-Green for comments but was unsuccessful in doing so.
