By Zena Henry Apart from the Local Government Ministry filing its answer as to why it chose Carol Sooba to fill the executive post of the city’s Town Clerk, Sooba has also provided an answer before Chief Justice Ian Chang in the High Court to represent her interest in the proceeding brought against the Ministry by Mr. Royston King.Carol SoobaThe matter continued at the High Court on Wednesday, when the defence was scheduled to provide their answer to King’s charge that Sooba was “unlawfully and arbitrarily” appointed as Town Clerk after the Minister ignored the recommendations of the panel set up by his office to choose the most suitable applicant for the post.The defence was afforded an additional seven days to file their answer, after they failed at the initial stage to do so within the 14 days stipulated by the court.Defence lawyer Adrian Smith, in partnership with senior lawyer Sadie Amin, provided the court with a reply to the plaintiff who is being represented by Attorney-at-law Nigel Hughes. Attorney Keshia Chase also informed the court that she had provided an answer on behalf of the Town Clerk.Hughes however opted to provide the court with a reply to the answer of the defence, within seven days. The sides are scheduled to put forward written submissions to argue their case at the next hearing of the matter.  The Chief Justice had noted at a previous sitting that he would afford the Town Clerk a chance to be heard, since she would be directly affected by whatever ruling the court would make.Sooba was appointed Town Clerk by the Local Government Minister, but this was against the choice of the panel that was set to hire the most suitable person to be secretary to Georgetown’s City Council. Panelists explained that Sooba was the least qualified of the applicants, yet she was chosen for the post.This forced King, who was the second most suitable applicant who contested for the job, to seek redress via the court. His case is that he had a legitimate expectation, that after abiding by the rules and requirements of the interview panel, that a legitimate decision would be made in relation to the criteria set.Norman WhittakerHe contended that the Minister would have established the interview panel, setting out criteria to identify the most suitable candidate, and that panel would have made certain requests that the applicants would have had to satisfy.It was further contended that the decision of the Minister deviated from those set criteria when Sooba was appointed Town Clerk. King is stating that when the Minister chose Sooba for the post of Town Clerk,Wholesale Jerseys, he did so by the powers vested in him and he did not take into consideration the criteria that the interview panel would have set, that the viable applicants would have satisfied rules and regulations, and further, ignoring the recommendations of the interview panel.However the Minister of Local Government, Ganga Persaud recently resigned and leaves an interesting twist as to the response of the Ministry.
