– finance Ministry to provide fundingFollowing on the heels of the recent meeting between the Executive and the Judiciary, a number ofMinister of Natural Resources, Raphael Trotmaninitiatives are on the cards for easing overcrowding, including the introduction of night courts to get more cases processed in a shorter time span.This was announced by Minister of Natural Resources, Raphael Trotman, on Thursday. He said that these measures were discussed at the Cabinet level on Tuesday and that the Ministry of Finance has already been approached for a special budgetary arrangement, though he declined to give a specific date for implementation.“A number of initiatives were itemized. From what I’ve heard,Ted Williams Red Sox Throwback Jersey, these are going to be implemented soon,Ryan Kent Liverpool Jersey UK,” he said. “Right now the thrust is to reduce the backlog of cases and to bring the number of prisoners, particularly in Camp Street, down. Of course, the Commission of Inquiry that is ongoing will also produce very good recommendations about the overall state of our penal system.”“We are looking at night courts between the hours of four and eight, to process cases (Magistrates Courts currently have sessions from 09:00hrs until 14:00hrs).The intention is not to send more people into the prisons, but only to process those who are being detained to see whether they should go on bail and so forth.”“Those are the initiatives that we hope to see in place within another few weeks. The Ministry of Finance has been approached about a special budgetary arrangement, because that was not contemplated in the 2016 budget. So that will have to come via a financial paper before Parliament. The next sitting of the National Assembly is May 4, so these are things we can expect soon.”Trotman added that only measures which are feasible would see immediate implementation. One example he gave was the suggestions that it was time to construct a new prison. He acknowledged that while it might be necessary, it was not feasible from a financial standpoint.“It might not be financially feasible now; it may have to be on a longer term basis. No doubt we need a new prison outside of Georgetown. (But) complaints about the condition of the prison have to be addressed immediately. You would know that with the assistance of the US government we have sent a large body of officers for training in how to react in emergencies.”Overcrowding and judicial sloth have been identified as some of the prevailing causes of prisoner discontent. This came to the fore when a catastrophic fire in the Camp Street penitentiary on March 3, resulted in the deaths of 17 prisoners and injuries to others.A CoI into the incident has since been launched on the orders of President David Granger. Prisoners from Camp Street have taken the stand, with part of their testimony attesting to the length of time their cases would take to be called.In its wake, the meeting between the Executive and Judiciary was arranged. The talks were held in the Boardroom of the Court of Appeal. Present were Prime Minister Moses Nagamootoo; Vice President and Minister of Public Security,Bernd Leno Jersey, Khemraj Ramjattan; Attorney General and Minister of Legal Affairs, Basil Williams; and Minister of State,San Diego Padres Luis Sardinas Jersey, Joseph Harmon.The justice system was represented by the Chancellor Carl Singh, Acting Chief Justice, Yonette Cummings-Edwards; Director of Public Prosecution, Shalimar Hack and Chief Magistrate Ann McLennan.The humanistic side of justicePrisoners during the recent disturbances at Camp Street.During a recent interview with former Chief Justice Ian Chang, he had offered insight into how the humanistic side of justice could be used to address overcrowding in the prisons. Chang stated that when it came to prisoners going on remand, it was important that with those offences for which they could be bailed, consideration is showed.According to Chang, he had adopted a policy of not refusing bail outright, but leaving that option open for the prisoner. The former Chief Justice (Ag) made it clear that discontent and resentment can potentially escalate if a feeling of hopelessness prevails in the system.Another contributory factor to overcrowding that has been highlighted is the many youths who have been incarcerated under the current Narcotic Drug and Psychotropic Substances Control Act 1988. The law stipulates that anyone found in possession of marijuana is liable to a fine of $10,000 or three times the monetary value of the drug.It also mandates that if in excess of 15 grams of cannabis, the offender must be sentenced to a minimum of three years’ imprisonment.Last year,Brendan Langley Broncos Jersey, the imprisonment of former national footballer turned coach, Vibert Butts, by a city Magistrate for the possession of marijuana sparked moves to change the law. A Bill seeking to amend the 1988 Act was drafted by Attorneys-at-Law Nigel Hughes and Mark Waldron.The Bill is also founded on the experience of several citizens—predominantly youths who have been incarcerated for small quantities of cannabis or cannabis resin,Fabio Borini Liverpool Jersey, and who as a result of their incarceration have not only added to the prison population, but have been exposed to hardened offenders.Trotman was asked about the fact that prisoners had cell phones in their possession. Over the past week, the fact that prisoners not only have cell phones, but also internet connection and drugs in their possession,Chelsea Jersey UK, has been highlighted in the media.“This is a phenomenon that we are seeing which is not unique to Guyana. We are in the throes of an information revolution. Guns have been known to be smuggled into this and other prisons. Cell phones, drugs, food and in some cases even conjugal visits have been common features. It happens all over the world.”“We expect that when this Inquiry is over, these matters will be addressed in terms of what ratio of officers to prisoners we need to increase or maintain. I don’t believe that the military has a role to be deployed in the prisons. They are for the defense of our national territory and to assist the police in issues of national security.”The Minister also responded to suggestions that Guyana’s prison service should be privatised. He stated that whether this is done or not might very well depend on the outcome of the CoI.“There have been suggestions that the prisons should be privatized as is done elsewhere whereby private security firms are brought in to take care perhaps of the softer parts of enforcement. So these are things that the CoI will have to consider and make recommendations on.”
