-lawyers applaud moveIn a landmark decision, Attorney at Law Mirza` Sahadat  successfully brought an action against Registrar Of Lands Juliet Sattaur in the High Court on behalf of his client Parbatie Khan which compelled her to deliver forthwith a certificate of Title to his client.Sahadat had decided on that course of action after the Registrar Of Lands  had refused to issue the land title to his client, who is the benefactor of a parcel of Land once owned by her deceased husband. The land which is described as parcel No201 Block XIX, zone C.R is a part of Skeldon Berbice  with buildings and other erections.The woman who is 77 years old, and lives at Lot 159 Line Path B Skeldon Corriverton, Corentyne Berbice, had applied for the title for the land which was willed to her by her late husband Hafiz Khan called Hafiq Khan and Hafiz.In her writ to the High Court she stated that she is the executrix of the Estate of her late husband who died in May 2010.  She stated that a probate was granted to her by the High Court in October 2010. The probate,Authentic NFL Jerseys Wholesale China, along with the last will and statements of Assets and Liabilities were all granted to her and presented to the Court.She stated that since December 3, 2010, she applied through her attorney Mr. Sahadat for the Certificate of Title for the land and has been given the royal run around. This is even though all her documents were properly filed. She suggested that the Registrar of Lands Ms Juliet Sattaur for no apparent reason had refused to issue the Certificate of title to her.The writ also said that Ms Sattaur continued to refuse to grant the title to his client even after repeated attempts to get her to do so. It also stated that the delay is unreasonable and had caused the woman much stress and inconvenience.  She noted that there was no impediment in granting the title since the Registrar had brought no queries to her attorney.The lawyer in the writ continued that it is the Public duty of the Registrar to process and issue Certificates of Title including his clients under the land Registry Act Chapter5:02.After the matter was heard before Justice Winston Patterson in the Berbice High Court an order was subsequently issued to the Registrar directing her to appear in court and to issue the Certificate of Title to the applicant.The writ thus read It is Ordered That an Order Nisi of Mandamus be issued directed to the  Registrar of Lands Juliet Sattaur to show cause why a writ of Mandamus should not be issued directed to her commanding her  to register the instrument of transfer presented for registration by the applicant . The writ was served on Ms Sattaur in her capacity of Registrar of Lands.The Registrar was summoned before the judge who subsequently granted the title.Over the years several persons have expressed their concern over the delays in acquiring their Land Titles and Transports.Speaking to the media Vice president of the Guyana Association of Legal Practitioners Mr. Joe Misir described the decision is a landmark one. He stated that the association is grateful for the action brought by Mr. Sahadat to address the issue.Mr. Misir said that over the years, a number of persons have cancelled their application in the courts due to the time that it takes for them to be granted their titles.  Overseas based Guyanese as well foreigners have all been affected, the veteran lawyer stated.He is hoping that by the ruling the Registrar will also understand that she is not above the law and has a duty to perform and must respect the Guyanese people.
